   Welcome to EMS Proficient Mobile Phlebotomy Service LLC ("Company", "we", "us", or "our"). These Terms of Service             ("Terms") govern your access to and use of our mobile phlebotomy services, including mobile blood collection, point-of-care         testing, DNA testing, and drug testing (collectively, the "Services"), as well as our website located at                                               https://www.emsphlebotomy.org  ("Site").

    By booking an appointment or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use our      Services or Site.

 

    1. DESCRIPTION OF SERVICES

​        EMS Proficient Mobile Phlebotomy Service LLC provides mobile phlebotomy and specimen collection services and                      testing.We act solely as an independent collection and point-of-care testing service. We collect biological specimens (blood,         saliva, urine, etc.) and  deliver them to third-party certified laboratories for analysis, or perform designated point-of-care                screening tests.

• No Medical Advice: Our staff are phlebotomists and collectors, not physicians. Content on our Site and information provided during Services do not constitute medical advice, diagnosis, or treatment. Always consult a licensed healthcare provider regarding your health or test results.

​

• Physician Orders: For clinical blood draws, clients must provide a valid laboratory order from a licensed healthcare provider unless using self-ordered screening testing where legally permitted.

 

   2. APPOINTMENTS, CANCELLATIONS, AND FEES

​

• Booking: Appointments must be scheduled in advance via our Wix platform or by phone.

​

• Mobile Service Fee: A non-refundable mobile convenience/travel fee is charged at the time of booking to secure your appointment slot.

​

• Cancellation Policy: Cancellations or rescheduling requests must be made at least 48 hours prior to the scheduled appointment time. Failure to do so, or failure to be present at the designated location within 15 minutes of the technician's arrival, will result in the forfeiture of your mobile service fee.

​

• Difficult Draws: Our technicians will make a reasonable, professional attempt to collect specimens. If a specimen cannot be obtained due to difficult vein access, dehydration, or uncooperative subjects, the mobile service fee remains non-refundable.

    Mobile Blood Collection Policy
    EMS Proficient Mobile Phlebotomy Service delivers professional, on-site blood draws. All collections require a valid                    physician's order, laboratory requisition form, or authorized legal request prior to scheduling. Clients must strictly follow all          pre-test medical instructions, such as fasting. Our phlebotomists are solely responsible for safe extraction and secure                      transport; sample analysis and results are managed independently by the processing laboratory.

     3. Point of Care Testing (POCT) Policy
      EMS Proficient Mobile Phlebotomy Service provides rapid, on-site point of care testing (POCT) directly to individuals, law          firms, and facilities. All tests require a valid physician's order or authorized medical request prior to mobile dispatch. Rapid            screening results are delivered on-site in real time. If a screening indicates the need for further clinical validation, samples              will be securely processed and transferred to our designated, accredited partner laboratory.

​    4. Legal DNA Testing Terms & Conditions​

​

• Identity Verification & Chain of Custody: To ensure court-admissibility, all legal DNA collections require strict compliance with Chain of Custody protocols. Every testing subject (or legal guardian) must present a valid, government-issued photo identification at the appointment time. EMS Proficient Mobile Phlebotomy Service reserves the right to capture facial photographs and in some cases fingerprints on-site as mandated by laboratory standards.

• Neutral Third-Party Collection: Our mobile phlebotomists act exclusively as certified, neutral third-party collectors. EMS Proficient handles sample extraction, identity documentation, tamper-proof sealing, and secure courier transit. We do not analyze samples, manage laboratory facilities, or influence test results.

• Laboratory Processing via DDC: All collected samples are dispatched and processed exclusively through DDC (DNA Diagnostics Center), an AABB-accredited laboratory. Turnaround times and testing accuracy are subject to DDC’s independent operating procedures and guidelines.

• Payment & Document Release Policy: Private-pay client cases must be funded in full at least 24 hours prior to the scheduled mobile dispatch time. For law firms utilizing corporate billing, final certified court-admissible results will be legally withheld and unreleased until all outstanding invoice balances with EMS Proficient are settled in full.

 

• Rapid Drug Testing Policy
  EMS Proficient Mobile Phlebotomy Service provides professional, mobile point-of-care rapid drug testing. All collections require strict adherence to standard donor identification protocols; valid photo ID must be presented at the time of testing. To prevent sample tampering, donors must follow all pre-collection security instructions. Turnaround times for rapid results are immediate on-site, while non-negative screens requiring confirmation are sent to an accredited laboratory

​        5. Assisted Living & Facility Terms

         EMS Proficient Mobile Phlebotomy Service provides dedicated on-site blood collection and point-of-care testing for                     eldercare facilities. Routine, stat, and point-of-Care testing service orders must be submitted by authorized staff.  While we           maintain standard medical liability insurance and strict HIPAA compliance, facilities must provide safe bedside access and             verify resident identities. Cancellations require a 48-hour notice to avoid a mobile dispatch fee. Monthly corporate billing is           subject to Net 30 terms.

 

    6. SMS TEXT MESSAGING PROGRAM DISCLOSURES (GoDaddy SMS Compliance)​

    By providing your mobile phone number on our Site forms or during booking, you explicitly consent to receive transactional        and promotional text messages from EMS Proficient Mobile Phlebotomy Service LLC, including appointment reminders,              arrival notifications, and service updates.

​

• Program Description: Messages are sent via GoDaddy Conversations to facilitate customer support, coordinate technician arrival times, and send requested test updates.

​

• Opt-Out Instructions: You can cancel the SMS service at any time. Just text STOP to our business number. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time.

​

• Help Instructions: For help, text HELP to our business number, or email us at info@emsphlebotomy.org.

​

• Cost and Frequency: As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your appointment scheduling and interactions with our business.

​

• Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.

 

   7. LIMITATION OF LIABILITY​

    To the maximum extent permitted by law, EMS Proficient Mobile Phlebotomy Service LLC and its employees shall not be             liable for any indirect, incidental, or consequential damages arising from the specimen collection process, delayed laboratory         results, or use of our Site. Our total liability for any claim arising out of our Services shall not exceed the total amount paid by       you for that specific service.Assisted Living Facility Website Policy.

​     8. INDEMNIFICATION

​      You agree to defend, indemnify, and hold harmless EMS Proficient Mobile Phlebotomy Service LLC from any claims,                   liabilities, damages, or expenses arising from your provision of false identification, fraudulent doctor orders, or breach of              these Terms.

 

        9. GOVERNING LAW

​          These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its              conflict of law principles.
